PAYMENT TERMS

TradeGuider Systems Ltd requires customers to provide credit card details at the time of ordering. The credit card will be authorized and billed for the full purchase amount using secure online purchasing facilities. We can also accept personal checks, money orders, wire transfers and cashier’s checks.

TRIAL PERIODS AND RETURNS POLICY

Our aim is to be completely fair and honest with all our customers. Therefore, our return policy is generous and reflects the value that we place in your custom. If you choose to return a product to us, all we ask is that you are fair and honest with us too. Here are the return policy details we want you to be aware of:

The 30-day trial period begins on the actual shipping date, and pertains only to boxed set End-of-Day and Real-Time Software products created and distributed by TradeGuider Systems. None of TradeGuider's Educational Books, multimedia CD Roms, DVD's or DVD\CD boxed sets qualify for the money-back guarantee. Additionally the Upgrade from End-of-Day to Real-time is not covered by the 30 day money-back guarantee.

In order to qualify for the 30-day money back guarantee you will be required to complete the viewing of the enclosed “Master the Markets” home study videos. Upon completion of each module, a check mark will automatically appear showing that you have completed that module. When all modules have been viewed in their entirety, an email will automatically be sent to TradeGuider Systems verifying your completion of the home study materials.

You will be refunded the entire purchase price of the product(s) you ordered if received by TradeGuider Systems within the allotted time period and if all materials are returned complete, undamaged and in a suitable condition for resale. All manuals included in the software programs must be returned to receive a refund. We highly recommend you insure your package. (Shipping and handling charges are non-refundable.)

Each customer is allowed one money-back guarantee per product.
If you do choose to return a product to us, please follow the important steps below:

1. Call TradeGuider Systems on 312-924-2884, allowing shipping time so that the
product arrives at TradeGuider Systems before the guarantee period expires.

2. Ask the sales representative for a Return Merchandise Authorization Number.
You’ll be asked for your name and address to verify the order, and then the
sales representative will give you a Return Merchandise Authorization Number.

3. On your Windows Taskbar, choose ‘Start’, then ‘Control Panel’. Double-click
‘Add/Remove Programs’. Select the ‘TradeGuider’ product you are planning
to return and then click ‘Remove.’ This will remove the product from your
computer.

4. Write the ‘Return Merchandise Authorization Number’ in the space on your Product Return documentation which came with the boxed Set and on the outside of the shipping box. Include the Product Return Documentation in the package when you return it to us.

5. Place the product to be returned, together with the card, in a package, and mail to:

6. If you paid with a credit card, TradeGuider Systems will refund your money to your credit card. If you paid by check, TradeGuider Systems will refund your money with a check. Thank you for choosing TradeGuider.

TRANSFER OF SOFTWARE

If at any time a customer wishes to transfer their software license to a third party, then the customer must inform TradeGuider Systems immediately. On transfer of the software license to the third party, the customer agrees to pay a standard transfer fee to TradeGuider - currently $199, to pay for the transfer administration and also ongoing life-time support of the software for the 3rd party.

LIMITATION OF WARRANTY AND DISCLAIMERS

In no event shall TradeGuider Systems Ltd be liable for any damages whatsoever, and in particular TradeGuider Systems Ltd shall not be liable for special, indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, or loss of use, arising out of or related to any TradeGuider Systems Ltd Web Site or the information contained in it, whether such damages arise in contract, negligence, tort, under statute, in equity, at law or otherwise. You also understand that TradeGuider Systems Ltd cannot and does not guarantee or warrant that files available for downloading through the Service will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the web site for the reconstruction of any lost data.

You assume total responsibility and risk for your use of the Web Site and the Internet. TradeGuider Systems Ltd does not make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or non-infringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to the Web Site, any merchandise, information or service provided through the Web Site or on the Internet generally, and TradeGuider Systems Ltd shall not be liable for any cost or damage arising either directly or indirectly from any such transaction. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advise, services, merchandise and other information provided through the Web Site or on the Internet generally. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

CONTENT AND LIABILITY DISCLAIMER

TradeGuider Systems Ltd shall not be responsible for any errors or omissions contained at this Web Site, and does not warrant that defects in the web site will be corrected. TradeGuider Systems Ltd reserves the right to make changes without notice and disclaims any responsibility for providing notice of such changes. In addition, TradeGuider Systems Ltd has no liability to make changes to existing product(s) and /or content. TradeGuider Systems Ltd does not warrant that the web site will be uninterrupted. Accordingly, all TradeGuider Systems Ltd and third party information is provided on an "AS IS, AS AVAILABLE" basis without warranties OF ANY KIND.

In no event will TradeGuider Systems Ltd be liable for (1) any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of profits, business interruption, loss of programs or information, and the like) arising out of the use or of inability to use the web site, or any information, or transactions provided on the web site or downloaded from the web site, even if TradeGuider Systems Ltd or its authorized representatives have been advised of the possibility of such damages, or (2) any claim attributable to errors, omissions, or other inaccuracies in the service and/or materials or information downloaded through the web site.

Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. In such states, TradeGuider Systems Ltd liability is limited to the greatest extent permitted by law.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless TradeGuider Systems Ltd, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the web site from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement or any activity related to your submissions to the web site (including negligent or wrongful conduct).
